Important. These Terms govern your use of our website and the bookings you make through it. They are subject to the Consumer Protection Act 68 of 2008, which gives you rights that cannot be taken away by contract.
1. STATUTORY DISCLOSURES (ECTA SECTION 43)
In accordance with section 43(1) of the Electronic Communications and Transactions Act 25 of 2002, the following information is provided:

2. ACCEPTANCE OF THESE TERMS
By accessing or using mrbankscar.co.za, or by submitting a booking through it, you accept these Terms. If you do not accept them, please do not use the site. We may change these Terms from time to time; the version in force is the one published on this page at the time you use the site.
3. WHO MAY USE THE SITE
You may use the site if you are at least 18 years old (or younger with the consent of a parent or guardian), acting for lawful purposes, and providing accurate information.
4. BOOKINGS
4.1 A booking submitted through the website is a request, not a confirmed appointment. Your booking is confirmed only once we contact you (by phone, SMS or email) to accept it and agree a date and time.
4.2 You agree to provide accurate booking details, including your name, contact number, address and vehicle information, and to ensure the vehicle and a safe, accessible working area are available at the agreed time.
4.3 We service the areas listed in clause 1. We may decline a booking that falls outside our service area or that we cannot safely or practically fulfil.
4.4 Postponement and cancellation. You may postpone or cancel a confirmed booking by contacting us as early as reasonably possible. We may postpone a booking due to weather, vehicle access, safety, staff availability or events beyond our control, and will offer you the next available slot. Your rights under the Consumer Protection Act are not affected.
5. SERVICES, PACKAGES AND PRICING
5.1 We offer once-off washes and recurring (monthly) detailing packages. The services, their contents and their prices are as published on the website from time to time. The price applicable to your booking is the price published at the time we confirm it.
5.2 Recurring packages continue monthly until you cancel. You may cancel a recurring package by contacting us; cancellation takes effect at the end of the current paid month unless we agree otherwise.
5.3 Prices are in South African Rand. Mr Banks is not registered for VAT, so no VAT is added to our prices and the price quoted is the price you pay.
6. PAYMENT
6.1 Unless otherwise agreed, payment is due on or after completion of the service, by the methods we make available (currently electronic funds transfer, cash, or card machine). We record your payment and can provide an invoice or receipt.
6.2 We do not currently take card or online payments through the website. If we introduce online payments in future, the payment will be handled by a third-party payment processor under its own terms, and we will update these Terms and our Privacy Policy accordingly.
6.3 If an amount is not paid when due, we may decline further service until it is settled, without affecting your rights under the Consumer Protection Act.
7. YOUR VEHICLE AND OUR SERVICE
7.1 We take reasonable care in handling your vehicle. Before we begin, please remove valuables and personal items from the vehicle; we are not responsible for loss of items left in the vehicle.
7.2 Please tell us in advance of any pre-existing damage, loose fittings, sensitive finishes, after-market parts or mechanical issues, so we can take appropriate care or decline work that carries undue risk.
7.3 We will perform the service with reasonable skill and care, as required by the Consumer Protection Act. If you believe the service was not performed to a reasonable standard, please tell us promptly so we can make it right.
7.4 Nothing in these Terms excludes our liability for damage caused by our negligence, or any liability that cannot be excluded under the Consumer Protection Act or other law.
8. WEBSITE USE AND PROHIBITED CONDUCT
You must not use the site for any unlawful purpose, attempt to gain unauthorised access to it, introduce malicious code, scrape or harvest data by automated means without permission, or misrepresent your identity. We may suspend access where we reasonably believe the site is being misused.
9. INTELLECTUAL PROPERTY
9.1 The "Mr Banks Car Detailing" name, logo and brand, and the content we publish on the website (text, images and our gallery), are owned by or licensed to Mr Banks and are protected by law. You may not copy or use them without our permission, except as needed to view the site normally.
9.2 The website and the underlying business-management software are built, hosted and maintained for us by Kopanong Platforms (Pty) Ltd, which owns the software and its code. Your use of the site does not give you any rights in that software.
10. AVAILABILITY
We aim to keep the website available, but we do not guarantee uninterrupted availability. We may suspend or change the site for maintenance, security or operational reasons.
11. DISCLAIMERS AND LIABILITY
11.1 To the maximum extent permitted by law, and save where the Consumer Protection Act imposes warranties that cannot be excluded, the website is provided "as is" and we do not warrant that it will be uninterrupted or error-free.
11.2 To the maximum extent permitted by law, we are not liable for indirect or consequential loss. Nothing in these Terms limits liability for fraud, gross negligence, death or personal injury caused by negligence, or any liability that cannot lawfully be limited, including under the Consumer Protection Act.
12. CONSUMER PROTECTION ACT
If these Terms, or any booking governed by them, are subject to the Consumer Protection Act 68 of 2008, no provision of these Terms is intended to contravene the Act. Every provision must be read as qualified to the extent necessary to comply with the Act, and where any provision is inconsistent with the Act, the Act prevails to the extent of the inconsistency.
13. PRIVACY
Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms.
14. GOVERNING LAW AND DISPUTES
These Terms are governed by South African law. We will try to resolve any dispute with you directly and in good faith. You retain your right to refer a complaint to the National Consumer Commission, a consumer court, or any other forum available to you under the Consumer Protection Act, and to approach a court of competent jurisdiction.
